Terms of Service

1. About these terms and the service

These Terms of Service form a binding agreement between you (the ‘User’, ‘you’) and Awakening Fertility, operated by Awakening Sovereignty Limited (company number 17108297) (‘we’, ‘us’, ‘our’). They govern your use of the Awakening Fertility website www.awakeningfertility.com / www.fertilelifestylecourse.com and AI coaching platform (the ‘Service’).

By creating an account, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy.

2. The Service is educational coaching, not medical advice

The Service is an AI-powered educational coaching platform built around Awakening Fertility’s fertility methodology. It does not provide medical advice, does not diagnose any condition, and does not prescribe any treatment. The AI persona is not a doctor, nurse, or licensed clinician.

You should consult a qualified healthcare professional for medical questions before starting any new supplement, dietary regimen, exercise programme, or fertility treatment, and before making any decision based on information you receive through the Service.

In an emergency, contact your local emergency services. Do not rely on the Service for any time-sensitive medical decision.

Where the Service offers interpretation of laboratory results (Phase 3), the interpretation is educational context within Fiona’s holistic framework, not a clinical reading. You and your doctor should be the source of any decisions about your treatment.

3. Eligibility

To use the Service, you must be at least 18 years old. You must have the legal capacity to enter into this agreement under the laws of your jurisdiction. The Service is not intended for use by minors and we do not knowingly collect personal information from minors.

If you are using the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

4. Your account

• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide truthful, accurate, and current information.
• You are responsible for all activity under your account.
• You must not share your account with anyone else.
• You must notify us immediately of any unauthorised access at support@awakeningfertility.com.

5. Acceptable use

You agree that you will not:

• Use the Service for any unlawful purpose, or in a way that violates these Terms.
• Attempt to extract, reverse-engineer, or replicate the AI persona, the underlying methodology, the system prompts, the retrieval database, or any related intellectual property.
• Use the Service to develop or train any competing AI system.
• Submit content that is unlawful, abusive, harassing, defamatory, or designed to harm any person.
• Submit content that infringes any third party’s intellectual property or privacy rights.
• Impersonate any other person or misrepresent your relationship with any person.
• Attempt to bypass the safety controls, classifiers, or rate limits of the Service.
• Attempt prompt injection, jailbreaks, or other adversarial attacks against the AI.
• Use automated means (scrapers, bots, crawlers) to access the Service except for the limited purposes explicitly permitted.
• Upload medical documents that are not your own, unless you have explicit authorisation from the data subject.

We may, at our sole discretion and without recourse, suspend or terminate accounts that breach these rules, with or without notice depending on the severity of the breach.

6. Subscriptions and payments

Some features of the Service are paid. Pricing, features, and billing terms are presented at the point of sign-up. By subscribing, you authorise us (and our payment processor) to charge the recurring fee on the cycle you have selected.

You can cancel your subscription at any time through the Service. Cancellation takes effect at the end of the current billing period; you retain access until then. We do not provide pro-rata refunds for unused portions of a billing period unless required by law.

UK and EU consumers:you have the right to cancel within 14 days of subscribing for a full refund (the ‘cooling-off period’), unless you have requested immediate access to digital content and acknowledged that doing so waives your cooling-off right (which we will make explicit at checkout).

US consumers: subscription auto-renewal terms comply with the California Automatic Renewal Law and equivalent laws in other US states. You will receive clear disclosure of renewal terms before subscribing, an acknowledgement of the renewal terms after subscribing, and an easy online cancellation mechanism.

Price changes: we will notify you at least 30 days before any subscription price increase. The new price will not apply to you until your next renewal.

7. Intellectual property

The Service, including its software, content (excluding user-generated content), the AI persona’s responses, the underlying methodology, the brand ‘Awakening Fertility’, the name and likeness of Fiona Boulton, and all associated intellectual property, are owned by us or by Fiona Boulton and licensed to us. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial purposes.

You retain ownership of the content you submit to the Service (your messages, uploads, profile information). By submitting content, you grant us a worldwide, royalty-free, non-sublicensable licence to host, process, transmit, and display that content solely as necessary to operate, secure, and improve the Service. We do not use your content to train any third-party AI model. We do not use your content for the personal benefit of any other user.

8. AI-generated output

AI responses are generated dynamically and grounded in Fiona Boulton’s coaching content. Output may contain errors or omissions. You should not treat AI output as authoritative or as medical advice.

You may use AI responses for your personal, non-commercial purposes. You may not republish AI output as your own work, use it to develop competing products, or attribute it to any source other than the Service.

9. Privacy

Our Privacy Policy explains what personal data we process and on what lawful basis. By using the Service, you acknowledge that you have read the Privacy Policy. Where consent is the lawful basis for any processing, we will request that consent separately and clearly.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided ‘as is’ and ‘as available’. We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, except as expressly required by law. We specifically disclaim any warranty that the Service will diagnose any condition, predict any health outcome, or substitute for clinical judgement.

UK consumers: nothing in these Terms limits or excludes your statutory rights under the Consumer Rights Act 2015, including your right to a service performed with reasonable care and skill.

US consumers: nothing in these Terms limits any non-waivable consumer right under applicable state or federal law.

11. Limitation of liability

To the fullest extent permitted by applicable law:

• We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.
• We are not liable for loss of profit, loss of business, loss of data, or loss of opportunity.
• Our aggregate liability to you under or in connection with these Terms (whether in contract, tort, statute, or otherwise) is capped at the greater of (a) the amount you paid us in the 12 months immediately preceding the event giving rise to the liability, or (b) £100 / US$100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

12. Indemnity

You agree to indemnify and hold us harmless against claims, losses, damages, and expenses (including reasonable legal fees) arising from (a) your breach of these Terms; (b) your misuse of the Service; (c) your infringement of any third party’s rights; or (d) content you submit to the Service that is unlawful or infringing. This clause does not limit your statutory consumer rights.

13. Termination

Either party may terminate this agreement at any time. You can close your account through your settings. We can terminate your account if you breach these Terms, if continued provision of the Service would breach applicable law, or for legitimate business reasons with at least 30 days’ notice.

On termination: your access ends, your data is deleted in accordance with our retention schedule (see Privacy Policy), and any clauses that by their nature should survive termination (intellectual property, indemnity, limitation of liability, dispute resolution) will survive.

14. Changes to these Terms

We may update these Terms. Material changes will be notified to you by email and an in-app notice at least 30 days before they take effect. If you do not accept the updated Terms, you can close your account during the notice period; otherwise, continued use after the effective date constitutes acceptance.

15. Governing law and dispute resolution

15.1 For users resident in the United Kingdom or European Economic Area

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that consumers may bring proceedings in the courts of their place of residence as required by mandatory law.

Before litigation, please contact us at support@awakeningfertility.com so we can try to resolve the matter directly. UK consumers may also use the UK government’s online consumer dispute resolution services.

16. Miscellaneous

• Entire agreement: these Terms, the Privacy Policy, and any additional terms presented in connection with specific features form the entire agreement between you and us.
• Severability: if any provision is found unenforceable, the remaining provisions will continue in effect.
• No waiver: our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment: you may not assign these Terms; we may assign on notice in connection with a corporate change.
• Notices: legal notices to us should be sent to support@awakeningfertility.com. We will give notices to you by email to your account address.
• Force majeure: neither party is liable for delay or failure caused by events beyond their reasonable control, except for payment obligations.
